Supreme Court Ruling Reignites Sunset Clause Debate

A high-stakes legal battle has tested the limits of Queensland’s sunset clause laws, with developer Cavcorp preparing to appeal a Supreme Court ruling.

The court ordered the developer to pay $6.1 million to an off-the-plan buyer.

Long controversial, sunset clauses have come under scrutiny from the state government and the media amid concerns they give developers the ability to cancel contracts and resell properties at higher prices.
