1. Privacy Statement
The Urban Developer.Com Pty Ltd ABN 97 169 148 958 trading as The Urban Developer (“we”, “our”, “us”) understand that you are concerned about your privacy, along with the confidentiality and security of any personal information that you provide to us. We consider your privacy to be important and take our responsibility to protect it seriously.
This privacy policy (Policy) sets out how we collect, hold, use and disclose personal information about individuals who deal or interact with us. We treat all personal information collected by us in accordance with the Privacy Act 1988 (Cth)(Privacy Act) including the Australian Privacy Principles, this Policy and any other applicable law.

Personal information is information or an opinion about an individual whose identity is apparent or can be reasonably ascertained.
We usually collect your personal information from you, including :

(b) when you interact with us, whether by telephone, email, ordinary mail, social media or any other electronic or online means;
(c) when you take part in our surveys or competitions;

(e) through any of our other business activities or events, including when you register or attend our in person or online events, courses, webinars, site tours or advertise with us.
There may be some instances where personal information about you is collected from someone else, including where someone is acting on your behalf or it is unreasonable or impractical for us to collect the personal information directly from you.
Personal information collected
The personal information that we collect and hold about you depends on our relationship with you and how and why you interact with us. The types of personal information typically collected by us includes:

We do not usually collect or hold government identifiers (i.e., passport number, licence number, Medicare number or tax file number). Where we do, such information will not be disclosed without your consent, unless we are required or authorised to do so by law.
Collecting sensitive information
Sensitive information is a special type of personal information that includes health information, racial or ethnic origin, political opinions and associations, religious and philosophical beliefs, trade union membership and associations, sexual orientation and practices, criminal record and biometric information.
We may collect and hold sensitive information about you where it is reasonably necessary for our functions and activities. For example, if you attend one of our events, we may need to collect health information about you relevant to your attendance, such as accessibility or dietary requirements.
We only collect sensitive information about you if you consent to the collection, except in limited circumstances such as in an emergency or where we are required to do so by law.
We ask that you only share sensitive information with us if it is relevant and do not share sensitive information with us about another person unless you have their consent to do so.
3. Why we collect, hold, use and disclose personal information
We collect, hold, use and disclose your personal information in the performance of our functions and activities, including for the following purposes:

(b) administering and managing your membership and accounts, including providing membership benefits and communicating with you about your membership and accounts;
(c) responding to your enquiry, feedback or complaint;
(d) monitoring your use of our websites and the provision of our services to you; (e) improving, personalising and developing our business and services. (f) maintaining our relationships with those that we provide our services to; (g) research and statistical purposes;
(h) promoting and marketing products and services provided by us, our associated entities and advertisers that we believe will be of interest or benefit to you;
(i) to provide to other entities so that they may promote and market products and services to you that we believe will be of interest or benefit to you;
(j) for our internal business administration and operations, including to detect, prevent and respond to suspicious, unlawful, dishonest or malicious activities, security incidents and breaches of our terms and policies; and
(k) to meet legal requirements and protect our legal rights and interests.
If we collect and hold your sensitive information, we will only use and disclose this information for the purposes we collected it for, unless your further consent is obtained, we are required to use or disclose the information by law or another exception under the Privacy Act applies.

4. What happens if we can’t collect your personal information
If the personal information you provide to us is incomplete or inaccurate, we may be unable to provide you with the services, product or information you are seeking.
5. Disclosure of personal information
We may disclose personal information about you to:
(a) our employees, volunteers, contractors, consultants and third party service providers who require this information to help us provide our services, operate our business and carry out our functions and activities (including payment processors, insurers, IT and technology service providers, marketing and advertising service providers, and professional advisers such as lawyers, accountants, and auditors);
(b) third parties to whom you have agreed we may disclose your personal information;
(c) a prospective investor or purchaser of our business or assets; and
(d) any other person that we are permitted or required by law to disclose your personal information to which may include government departments and law enforcement agencies.
Overseas disclosure
While we are based in Australia and store some personal information in Australia, we may disclose your personal information overseas where our third party service providers or partners store data or are located overseas. Our third party service providers and partners may change from time to time.
If we disclose your personal information overseas, we take reasonable steps to make sure there are privacy and security arrangements in place to protect your personal information.
6. Direct marketing
We may use and disclose your personal information for the purpose of direct marketing where you have provided your consent or we are otherwise permitted to do so. We will always obtain your consent before using or disclosing your sensitive information for the purpose of direct marketing.
You can opt-out of receiving direct marketing from us at any time by using the unsubscribe facility contained in the direct marketing communication or contacting us at admin@theurbandeveloper.com.
Opting out of a direct marketing communication using the unsubscribe facility in the communication will only unsubscribe you from the organisation that sent you the communication. Please let us know if you want to unsubscribe from all direct marketing that originates from us by emailing admin@theurbandeveloper.com.
7. Protecting your personal information
(a) The security of your personal information is important to us. We take reasonable steps to protect personal information we hold from:
(i) misuse, interference and loss; and
(ii) unauthorised access, modification or disclosure.
(b) The steps we take to protect personal information include:

Deleting your personal information
We will take reasonable steps to destroy or permanently de-identify personal information when it is no longer needed for any purpose permitted under the Australian Privacy Principles.

9. Web beacons
Web beacons (also know as clear gifs, pixel tags or web bugs) are tint graphics with a unique identifier and have a similar function to cookies. They are used to track the online movements of web users, to access cookies stored on your device and collect data. Unlike cookies which are stored on your device, web beacons are embedded invisibly on web pages (or in email). Web beacons may be used to deliver or communicate with cookies, to count users who have visited certain pages and to understand usage patterns and interactions with advertisements. You should be aware that your ability to opt-out of a third party tool or platform will depend on the conditions governing your agreement with that third party.
Social networking services
We may use social networking services such as X (formerly Twitter), Facebook, Instagram, LinkedIn and YouTube to communicate with the public.
When you communicate with us using these services, we may collect your personal information (including your name, handle/username and contact information) but we will only use this information to communicate with you.
The social networking service will also handle your personal information for its own purposes in accordance with their own privacy policies and practices. We are not responsible for the privacy practices of social networking sites and social networking sites are not subject to our privacy policies and procedures.
11. Accessing and updating your personal information

You may request access to the personal information we hold about you by making a written request to admin@theurbandeveloper.com. We will respond to your request within a reasonable period. We may charge you a reasonable fee for processing your request (but not for making the request for access) and you may be asked to verify your identity before access is given.
We may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will give you a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.
Correcting your personal information
If you wish to correct the personal information that we hold about you, please contact us by emailing admin@theurbandeveloper.com. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.
If we refuse to correct your personal information, we will give you a written notice that sets out our reasons for our refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.
12. International users
If you are located outside Australia and choose to provide your personal information to us, your personal information will be transferred to Australia and processed in accordance with this Policy.
13. Complaints
We strive to ensure our compliance with this Policy and to regularly review our practices against it.
If at any time you have a complaint against us regarding our Policy, including a breach of the Privacy Act or Australian Privacy Principles, we invite you to make a complaint at admin@theurbandeveloper.com. All complaints made will be dealt with in confidence. We endeavour to respond within 30 days of receipt of a complaint with a resolution or proposed resolution to the issue raised.
If you are dissatisfied with our response to your complaint you may make a further complaint to the Office of the Australian Information Commissioner about the handling of your personal information. We may vary this Policy from time to time to ensure that we remain up to date with our business activities, market expectations, the law and technological advances.
